1. GENERAL

Welcome to Angelifybeauty.com ("Website" "Site"). The Terms and Conditions set out herein governs your use of our Site and your conduct irrespective of your location or the device you are using to access this site.

We strongly advise that you read these Terms of Service carefully and make sure that you thoroughly understand them before you continue to use this website or our mobile application ("App") (collectively "Platform").

Angelify Beauty (" We" "Us" "Our") owns and operates this Website. This document governs your relationship with www.angelifybeauty.com as well as our mobile application. Access to our products and services  (collectively, the “Services”) via this website or our mobile application are subject to the following terms and conditions  (the “Terms”). 

The Terms contained herein and in other Policies referenced herein apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

The Terms and Conditions should be read together with our Privacy Policy, Shipping Policy and Cancellation Policy, Refund and Return Policy, Cookie Policy ("Policy" "Policies"). These parts together or applied separately form a legally binding contract between you and us. If there is any inconsistency between the terms in the aforementioned documents, the Terms and Conditions in this document shall have precedence.

By using our Services, you ("User" "Users" "Your") agree to all of the Terms stated herein and as amended from time to time and you agree and acknowledge that this establishes a legally binding contract between us.

You can review the most current version of this Terms and Conditions at any time on this page. We reserve the right to update, change or replace any part of this Terms and Conditions without notifying you. It is your responsibility to check this page periodically for changes. Your continued use of or access to our Platforms following the posting of any changes constitutes an acceptance of those changes and establishes a legally binding contract between us. You are advised to check this page from time to time to stay updated on any changes we may make to this Terms and Conditions.

You acknowledge and agree without limitation to be bound by these Terms and Conditions as well as every Policy referred to, whether you have read the same or not. If this Terms and Conditions constitute an offer, acceptance is expressly limited to these Terms and Conditions and other Policies referred to as applicable.

We advise that you download or save a copy of this Terms and Conditions for future reference.

2. INTERPRETATION 

2.1 Unless the context otherwise requires, references to the singular include the plural, and references to the masculine include the feminine, and vice versa.

2.2 The headings contained in these Terms and Conditions are for convenience only and do not affect their interpretation.

2.3 References to any statute or statutory provision shall, unless the context otherwise requires, be construed as a reference to that statute or provision as from time to time amended, consolidated, modified, extended, reenacted, or replaced.

2.4 The term "including" does not exclude anything not listed.

3. PRODUCT AND SERVICES

3.1 The images of products on our website are solely for illustrative purposes. Although we have made every attempt to show colors accurately, we cannot however guarantee that the colors of any product will be accurately displayed on a user's device or that product descriptions will be accurately spelt.

3.1.1 With all sizes, weights, capacities, dimensions, and measures given on our website, we make every attempt to be as accurate as possible.

3.1.2 The packing of a product may differ from that depicted on our platforms.

3.2 We reserve the right without prior notice to you to rectify errors/ inaccuracies, change images and/ or update information on the website even after an order has been made.

3.3.  If at any time, a product or service is recommended to you on our platform, such recommendation is for your information and convenience only. It does not constitute an endorsement of the product or service by us. 

3.4 Angelify Beauty is not responsible for any side effect(s) you may experience as a result of using any beauty product purchased on our platform. You are advised to consult a professional before applying any beauty product on your skin.

3.5. The products available for sale on our Platforms, and any samples we may provide to you, are for personal use only.

3.6. We reserve the right to at our sole discretion change or discontinue any product or service at any time. If we are unable to deliver the product to you on time or at all, we will notify you via email, and your order will be automatically canceled owing to product unavailability or at your request due to our delivery partners' inability to deliver the product by the expected delivery date. Angelify Beauty will not be liable for any losses incurred as a result of the order cancellation or delivery delay.

3.6.1 We reserve the sole discretion to change prices of products and services provided or offered on our platforms without prior notification to you.

4. PRICE AND PAYMENT 

4.1. The price of any products/ services will be as quoted on our Platforms from time to time, except in cases of obvious error.  

4.1.1 Delivery costs (as shown at the time you place the order) will be added to and included in the total amount due.

Prices are liable to change at any time, but changes will not affect any orders we have accepted. We will, however, endeavour to provide reasonable notice of any price increases.

4.2 Where a product/service is listed at an incorrect price, we reserve the right to refuse/ cancel an order placed for such a product (we will however contact you via the email address you provided at the time the order was made) except in cases where delivery of the product/ service has been made.

4.3 Where we accept your order, the amount will be deducted from your credit/debit card account and you will be notified via email that the payment has been completed. The payment will be processed prior to dispatching the product you ordered.

4.3.2 If for any reason, there is a need to cancel an order after it has been processed, the money will be reversed to your credit or debit card account.

4.4. Payments are processed on our behalf by our authorised payment provider using appropriate encryption and security measures. We do not hold any payment or transaction details on our servers or the website.

4.4.1 If we are unable to charge your credit or debit card with the full amount of the product you ordered, or if we are charged back for any fee previously charged to your credit or debit card, we reserve the right to pursue all available remedies to recover payment including without limitation, suspension or termination of your account with us and rights to all services from our Platforms.

4.4.2 Angelify Beauty will never charge your payment card or PayPal twice. If you believe you have been charged twice, contact your payment service provider.

5. CANCELLATION

5.1 All cardholders are subject to validation checks and authorisation by the card issuer. If for any reason the issuer of your payment card refuses to or does authorise payment to us, we will cancel the order.

5.2 Where a product is not in stock or the one(s) in stock is/are not in good condition or defective, we reserve the right to cancel the order and refund your money in full.

5.3 You may cancel any order placed prior to our dispatch of goods by sending an email to support@angelifybeauty.com within 30 minutes of placing an order. Read our Cancellation Policy to learn more.

5.3.1 Cancellation requests sent before 3 pm on weekdays will be processed the same day. Cancellations after this time and on non-working days will be processed the next working day.

6. SHIPPING AND DELIVERY

Please refer to our Shipping and Delivery Policy provided.

7. PRIVACY POLICY

We undertake to comply with the terms of our privacy policy.

8. SECURITY OF INFORMATION

Unfortunately, no data transmissions over the internet can be guaranteed as totally secure. Whilst we strive to protect such information, we do not warrant and cannot ensure the security of any information which you transmit to us. Nevertheless, once we receive your transmission, we will take reasonable steps to preserve the security of such information.

9. HOW WE HANDLE E-MAILS

We may monitor and preserve the content of emails you send to us if we have any reason to suspect any form of email abuse or if we believe that we have the legal duty to do so.

10. YOUR ACCOUNT

10.1 By using any Angelify Beauty platform, you guarantee that you are 16 years old or above. 

10.2 You agree that any minor using your account does so under your supervision and you agree to be liable for every activity carried out using your account.

10.3 You acknowledge and agree that you are responsible for maintaining the confidentiality of your account and password.  

10.4 You agree that you have the capacity to bind a third party to this Terms and Conditions (and every Policy referenced herein) if you are accessing our Platform(s) on behalf of that third party.

10.4.1 Should the third party refuse to be bound to this Terms and Conditions, you agree to be solely liable for harm occasioned by the wrongful use of our Platform(s).

10.5 You agree and acknowledge that the information you submitted while creating your account is not confidential and they do not infringe on any right of a third party.

10.6 If you suspect that the security of your account and/or password has been compromised, you agree to send us a message immediately at support@angelifybeauty.com. We may ask you to change your password, or we suspend or ban your account from accessing our Platform(s).

11. REVIEWS AND COMMENTS

11.1 At our sole discretion, we may choose to publish or not to publish feedbacks/reviews received from you.

11.2 The opinions of users are solely their opinion and do not in any way confer any endorsement/ approval by Angelify Beauty. 

11.3 We reserve the right to remove or exclude at our discretion any review or rating that we deem inappropriate at any time. We are not required to give any reason for such actions.

12. CHAT FUNCTIONALITY

On our Platforms, you can access the Chat functionality for any queries as regards our products/ services. Our online Customer Care Representative will attend to your queries. The use of this service is subject to the following conditions:

 

1. Angelify Beauty may suspend the chat service at any time without prior notice to you.

 

1. Neither Angelify Beauty, its staff including its online Customer Care Representative will be responsible for any delay caused in attending to or replying to the queries via chat.

 

iii. You agree not to communicate any objectionable information i.e. unlawful, threatening, abusive, defamatory, obscene information while using the chat functionality.

 

1. We reserve the right to store communication through the chat for future reference and the user of such service will not have the right to access such information at any future date.

 

1. You agree not to use the chat room to sell any products, to give suggestion on business opportunities, or any other form of solicitation.

 

By using the chat functionality, you agree to the conditions stated above.

 

14. 14. USER CONTENT

 

14.1 You agree to be solely responsible for any information, photo, image, chat communication, text, software, data, music, sound, graphics, messages, videos, or other materials transmitted, uploaded, posted, emailed, or otherwise made available to us ("User Content"), and we will not be held responsible, in any manner whatsoever, in connection to the User Content. 

 

14.2 We shall in no way be held responsible for examining or evaluating User Content, nor do we assume responsibility or liability for the User Content. We do not endorse or control the User Content transmitted or posted on our Platform(s) by you and therefore, we do not guarantee the accuracy, integrity, or quality of User Content. 

 

14.3 You agree not to encourage or assist or engage others as well as yourself in transmitting, hosting, displaying, uploading, modifying, publishing transmitting, updating, or sharing any information that belongs to another person and to which you do not have any right to; is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, paedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, trolling, propaganda or otherwise unlawful in any manner whatever; harm minors in any way; infringes any patent, trademark, copyright or other proprietary rights;

violates any law for the time being in force;

deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;

impersonate another person;

contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer resource;

threatens the unity, integrity, defence, security of any country, or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.

 

14.4 You understand that by using the Site, you may be exposed to User Content that is offensive, indecent, or objectionable to you. Under no circumstances will we be liable in any way for any User Content, including without limitation, for any errors or omissions in any User Content, or for any loss or damage of any kind incurred by you as a result of the use of any User Content transmitted, uploaded, posted, emailed or otherwise made available via our Platform(s). 

 

14.5 In connection with User Content, you hereby agree not to hold Angelify Beauty liable for any alleged or actual infringements of any proprietary rights, rights of privacy and publicity, moral rights, and rights of attribution. 

 

14.6 You acknowledge and agree that we have the sole right (but not the obligation) to refuse to post or remove any User Content.

 

14.7 You acknowledge and agree that we reserve the right to change, condense, or delete any User Content. Without limiting the generality of the foregoing or any other provision of these Terms and Conditions, Angelify Beauty has the right to remove any User Content that violates these Terms and Conditions or is otherwise objectionable and further reserves the right to refuse service and/or terminate accounts without prior notice for any user(s) who violate these Terms and Conditions or infringe the rights of others.

 

14.8 Should you desire to delete your User Content on our Platform(s), send an email to us at support@angelifybeauty.com. Include the following personal information in your deletion request: first name, last name, user name/screen name (if applicable), the email address associated with our Site and/or mobile applications, your reason for deleting the posting, and date(s) of posting(s) you wish to delete (if you have it). If you are unable to provide the aforelisted information, we may not be able to process your deletion request. Please allow up to 30 business days to process your deletion request.

15. INTELLECTUAL PROPERTY

 

All content available on our Platform(s) including, but not limited to, text, graphics, logos, button icons, images, data compilations, and software, and the compilation thereof (collectively, the "Content") are the property of Angelify Beauty and are protected by international copyright laws as well as the copyright laws of the United Kingdom. The trademarks, logos, and service marks displayed on our Platform(s) collectively, the "Trademarks") are the registered and unregistered marks of angelic Beauty and are protected by the trademark laws of the United Kingdom and international trademark laws. You acknowledge that all other Trademarks not owned by Angelify Beauty that appear on our Platform(s) are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored Angelify Beauty. 

 

All materials, including images, text, illustrations, designs, icons, photographs, programs, music clips, downloads, video clips and written and other materials that are part of this Site (collectively, the "Contents") are intended solely for personal, non-commercial use only.

 

Angelify Beauty and its suppliers and licensors expressly and exclusively reserve all the intellectual property rights in all text, programs, products, processes, technology, content, software and other materials on our Platform(s). The compilation, collection, arrangement and assembly of the content on the Site is the exclusive property of Angelify Beauty.

 

You agree not to copy, reproduce, duplicate, republish, download, post, transmit, distribute or modify any material on our Platform(s) in whole or in part or in any other form whatsoever, except for your personal, non-commercial use only. No right, title or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying, reproducing, duplicating, republishing, posting, transmitting, distributing or modifying. Consequently, no Content, Trademark, nor any other portion of our Platform(s) may be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited, in whole or in part, for any purpose without our prior written consent.

We are not responsible for the content of any off-Site pages or any other Sites linked to or from the Platform(s). Links appearing on our Platform(s) are for convenience only and are not an endorsement by us, our affiliates or our partners of the referenced content, product, service, or supplier. 17. LIMITED LICENSE

17.1 We grant you a limited, revocable, and non-exclusive license to access and make personal use of our Platform(s). 

This limited license does not include the right to:

2. modify or download the Platform(s) or its contents (except caching or as necessary to view content);

2. use any meta tags or any other "hidden text" utilising our name or the Trademarks; or 

vii. use software robots, spiders, crawlers, or similar data gathering and extraction tools, or take any other action that may impose an unreasonable burden or load on our infrastructure.

 

17.2 We reserve the right, at any time, without notice, and at our sole discretion, to terminate your license to use our Platform(s) and to block and prevent your future access to our Platform(s).

18. YOUR OBLIGATIONS AND RESPONSIBILITIES

In the access or use of the Platform(s), you shall comply with this Terms and Conditions and the special warnings or instructions for access or use posted on the Platform(s). You shall always act in accordance with the law, custom and in good faith. You may not make any change or alteration to the Platform(s) or any Content or services that may appear on our Platform(s) and may not impair in any way the integrity or operation of the Platform(s). 

 

Without limiting the generality of any other provision of this Terms and Conditions, if you default negligently or willfully in any of the obligations set forth in this Terms and Conditions (including every other Policy referenced herein), you shall be liable for all the direct and indirect losses and damages that this may cause to Angelify Beauty, our affiliates, partners or licensors.

 

19 REPRESENTATIONS AND WARRANTIES

 

OUR PLATFORMS ARE PRESENTED "AS IS." WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, IN CONNECTION WITH THE TERMS AND CONDITIONS STATED HEREIN OR THE PLATFORM(S), INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE, EXCEPT TO THE EXTENT SUCH REPRESENTATIONS AND WARRANTIES ARE NOT LEGALLY EXCLUDABLE. 

 

You agree that, to the fullest extent permitted by applicable law, we will not be responsible or liable (whether in contract, tort or otherwise), under any circumstances, for any 

1. interruption of business; 
2. access delays or access interruptions to our Platform(s); 

iii. data non-delivery, misdelivery, corruption, destruction or other modification; 

1. loss or damages of any sort incurred as a result of dealings with or the presence of off-site links on the site; 
2. computer viruses, system failures or malfunctions which may occur in connection with your use of the site, including during hyperlink to or from third party sites; 
3. any inaccuracies, omissions or misleading, false or deceptive statement in the content; or 

vii. events beyond our reasonable control. 

 

To the fullest extent permitted by law we will not be liable for any direct, indirect, special, incidental, or consequential damages of any kind (including lost profits) related to our Platform(s) regardless of the form of action whether in contract, tort (including negligence), or otherwise, even if we have been advised of the possibility of such damages.

 

20. TERMINATION

These Terms of Use are effective unless and until terminated by either you or Angelify Beauty.

 

21. INDEMNIFICATION

You agree to indemnify Angelify Beauty for any loss, damages or costs, including reasonable solicitors' fees arising from any third party claim, action, or demand resulting from your use of the Platform(s). You also agree to indemnify us for any loss, damages, or costs, including reasonable solicitors' fees, resulting from your use of software robots, spiders, crawlers, or similar data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on our infrastructure.

 

22. FORCE MAJEURE

Deliveries or performances, which cannot be undertaken or are delayed due to events of force majeure or other unforeseeable events beyond our control or unforeseeable obstacles, which we  may suffer, authorizes us to deliver at a later point in time or to rescind the agreement in whole or in part, and you shall have no claim for damages in regards to same. 

 

An event of Force Majeure under this clause shall mean an external event, introduced from the outside by elemental forces or by actions of third parties, that is unforeseeable by human judgement and experience, which cannot be prevented or rendered harmless with economically bearable means even with the utmost care that can be reasonably expected according to the circumstances, and which must not be accepted by the company because of its frequency like. In particular Force Majeure includes but is not limited to war, terror act, administrative order of a public authority, pandemic, epidemic, malfunctions, strikes, lock outs, go slows, transportation obstacles and any other unpredictable obstacles.

 

23. GOVERNING LAW

These terms and conditions are governed by the laws in force in the United Kingdom of Great Britain and Northern Ireland. You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction. You hereby agree to submit all disputes to the jurisdiction of the courts in the United Kingdom of Great Britain and Northern Ireland.

 

Any dispute or difference either in interpretation or otherwise, of the Terms and Conditions and other Policies on the Platform(s), between the parties hereto, shall be referred to an independent arbitrator who will be appointed mutually and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration Act 1996 (Arbitration Act) or the Arbitration law in force at the time of the dispute.

 

24. ENTIRE AGREEMENT

If any part of this Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed to be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms and Conditions shall continue to be in effect.

 

Nothing contained in these Terms and Conditions shall be construed as creating any agency, partnership, affiliation, joint venture or other form of joint enterprise between us. Our failure to require your performance of any provision hereof shall not affect our full right to require such performance at any time thereafter, nor shall our waiver of a breach of any provision hereof be taken or held to be a waiver of the provision itself. In the event that any provision of these Terms and Conditions shall be unenforceable or invalid under any applicable law or be so held by any applicable arbitral award or court decision, such unenforceability or invalidity shall not render these Terms and Conditions unenforceable or invalid as a whole but these Terms and Conditions shall be modified, to the extent possible, by the adjudicating entity to most fully reflect the original intent of the parties as reflected in the original provision. The headings in the Terms and Conditions are for convenience only and shall not be used in its interpretation.
